FMLA

The Family and Medical Leave Act (FMLA) among other things, requires certain actions from employers.  This page is designed as a guide for managers. 

What must a manager do if they are told about an FMLA event or suspect a person may be missing (or planning to miss) work due to an FMLA event? 

ALWAYS MAKE A COPY OF WHAT YOU GIVE THE EMPLOYEE
AND PLACE IT IN THE EMPLOYEE'S FILE

THERE ARE THREE STEPS YOU MUST TAKE.  THEY ARE AS FOLLOWS:

Step 1.  Issue the Notice of Eligibility.  You can do so by printing and completing this form then giving it to the employee along with the correct Certification form from step 2.  Click here for the form.

Step 2.  Issue the correct Certification form as outlined below.

    • If the employee has a serious health condition, click here for the form.  Managers should complete section 1, then give the form to the employee.
    • If a family member of the employee has a serious health condition, click here for the form.  Managers should complete section 1, then give the form to the employee.
    • If the employee has a family member who is being deployed by the military, click here for the form.  Managers should complete section 1, then give the form to the employee.
    • If the employee has a family member who is returning from deployment with a serious health condition, click here for the form.  This form is completed entirely by the employee. 

Step 3.   Designate the time off as FMLA-protected and inform the employee of the amount of leave that will be counted against the employee’s FMLA leave entitlement, click here for the form.  This form is completed entirely by the manager.  Give a copy of the completed form to the employee.
